Affidavits-of-service filed in Court today are taken on record. 2. The petitioner seeks additional increment on account of his joining the upgraded school in terms of the Memorandum No.30- SE(B)/5B-1/2009 dated 10th February, 2010 and the Government Order No.1003-SE(S)/5P-129/12 dated 4th December, 2014. 3. Withdrawal of the aforesaid Government Order dated 4th December, 2014 by the subsequent order of the Joint Secretary (Secondary), School Education Department, Secondary Branch dated 22nd March, 2017 has been set aside by the Court on 15th January, 2024 in WPA No.6217 of 2021. 4. It appears that the petitioner is yet to apply for release of the additional increment. 5. In view of the above, the instant writ petition is disposed of with the observation that it will be open for the petitioner to apply before the Commissioner of School Education, West Bengal for grant of Page 2 additional increment in terms of the memorandum dated 10th February, 2010 and 4th December, 2014. 6. A decision shall be taken by the authority in accordance with law and in line with the order passed by the Court at the earliest but positively within a period of eight weeks from the date of communication of this order. 7. If the prayer of the petitioner is allowed, then necessary consequential steps shall be taken by the aforesaid authority. 8. Learned counsel for the petitioner shall forward a copy of all relevant notifications and judgments of this Court at the time of forwarding the application for grant of additional increment. 9. The writ petition stands disposed of. 10. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court. 11. Certified copy of the server copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
