ORDER:
This Criminal Petition has been filed under Section 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity “the BNSS”) by the petitioners/accused Nos.1 and 2 for granting of regular bail in connection with Crime No.61 of 2026 of Government Railway Police Station, Vizianagaram, registered for the alleged offence punishable under Section 20(b)(ii)(B) r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act, (for brevity ‘NDPS Act’).
2. Heard Sri Gollapalli Maheswara Rao, learned counsel for the petitioner, and the Ms.P.Akhila Naidu, learned Assistant Public Prosecutor appearing on behalf of the State/respondent.

The case of the prosecution is that on 06.05.2026 at about 11.00 hours, on receipt of credible information, the Sub-Inspector of Police along with his staff proceeded to the South end of Platform No.01 of Vizianagaram Railway Station, and while conducting checks, apprehended the two accused who were found illegally possessing and transporting 16 Kgs of ganja in two trolley bags.

Learned counsel for the petitioners submits that the petitioners are aged about 22 years and 19 years respectively. He further submits that the petitioners have not committed any offence and are innocent. It is also

contended that they have been falsely implicated in the present case and that they are the sole breadwinners of their respective families. He further submits that the petitioners are ready to abide by any conditions imposed by this Court and prays to enlarge them on bail. 5 Per contra, the learned Assistant Public Prosecutor submits that the investigation is not yet completed and the inventory is also pending. It is further submitted that some more witnesses are yet to be examined and so far only four witnesses have been examined. Hence, she prayed for dismissal of the bail petition.
7. Thoughtful consideration is bestowed on the arguments advanced by the learned counsel on both sides. I have perused the entire record.
8. In the light of the case of the prosecution and the contentions of the
learned Counsel for both the sides, now the point for consideration is:
“Whether the petitioner is entitled for grant of bail?”
9. The allegations against the petitioners are that on 06.05.2026, the Sub- Inspector of Police, Government Railway Police Station, found them in possession and transportation of 16 Kgs of ganja. The petitioners were arrested on 06.05.2026 and since then they have been in judicial custody. They were apprehended at the spot. It is also noted that there are no adverse antecedents reported against them. The petitioners are aged 22 years and 19 years respectively. However, the inventory is pending and so far only four

witnesses have been examined. Some more material witnesses are yet to be examined.

Having regard to the facts and circumstances of the case, the gravity and nature of the allegations levelled against the petitioner, and the stage of investigation, this Court is not inclined to enlarge the petitioner on bail, as the request of the learned counsel for the petitioner, is not found convincing and reasonable.
Hence, the Criminal Petition is dismissed.
