Learned advocate for the State opposes the prayer for bail and produces the case diary. I have taken into account the materials appearing in the case diary particularly the genesis of the case which portrays the incident of 2021. 2 Having considered the overall circumstances, I am of the opinion that custodial detention of the present petitioner is unwarranted in the facts and circumstances of the case. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Biplab Choudhury @ Biplob Choudhury] be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioner shall meet with the investigating officer of the case as and when called for by the Investigating Officer.
