The writ petition was filed, inter alia, praying for a direction upon the respondent municipality to cancel the sanctioned building plan dated 4th December, 2019 and the sanctioned plan No. 520 dated 20th February, 2022 in respect of 344, Mahendra Chandra Garden Road, ward No. 14, South Dum Dum Municipality. 2. On 2nd July, 2026, Ms. Bhattacharya, learned advocate representing the petitioners after arguing the matter for some time, had prayed for an accommodation as she could not demonstrate that the petitioners had applied before the municipality for cancelation of the building plan. WPA 7244 of 2026 3. Today, at the time of call, the petitioners are not represented though the municipality is represented. 4. The learned advocate for the municipality would submit that the petitioners have not previously applied for cancelation of the building plan. The writ petition does not disclose any application. 5. Having regard to the above, since the petitioners have not even bothered to make any representation or demand of justice, I am of the view that the writ petition cannot be sustained. 6. Accordingly, the writ petition is dismissed without any order as to costs. (Raja Basu Chowdhury, J.)
