CRM-M-37207-2026(O&M) 1 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-37207-2026(O&M) Date of decision: 13.07.2026 Rajesh Kumar … Petitioner Versus State of Haryana … Respondent
CORAM: HON’BLE MR. JUSTICE SANJAY VASHISTH Present: Mr. Jasvinder Rana, Advocate, and Mr. Kunal Singh, Advocate, for Mr. Rahul Singh, Advocate, for the petitioner. Ms. Malvika Singh, DAG, Haryana. *** SANJAY VASHISTH, J. (ORAL)
1. Instant petition has been filed under Section 528 of BNSS, seeking quashing of FIR No.880, dated 03.12.2025, under Section 209 of BNS, 2023, read with Section 174-A IPC, registered at Police Station Karnal Civil Lines, Karnal, and all consequential proceedings arising therefrom.
2. On oral request of learned counsel for the petitioner, complainant-Shriram Finance Limited, First Floor Patiala Road near Court Narwana, District Jinda, Haryana, is hereby ordered to be impleaded as respondent No.2. Let amended memo of parties in this regard be filed by counsel for the petitioner in the Registry itself, within a period of two days from today, without moving any application.
3.
Learned counsel for the petitioner contends that, in fact, on the issue of non-payment of loan amount obtained from respondent No.2, a complaint under Section 138 of Negotiable Instruments Act was instituted against the petitioner by respondent No.2. However, on payment of the RAJAN 2026.07.15 10:01 I attest to the accuracy and integrity of this document
CRM-M-37207-2026(O&M) 2 complete loan amount by the petitioner, Loan Closure Letter dated 20.05.2026 (Annexure P-4) was issued by respondent No.2-Shriram Finance Limited to the petitioner detailing therein that loan agreement No.HISAR0304250002-HR32G-3293 is settled and no other claim is outstanding against the referred loan account. Further, submits that the complaint filed by respondent No.2 had also been withdrawn by the complainant-respondent No.2 on 30.05.2026 (Annexure P-3), which was pending before the Presiding Officer, Special Lok Adalat, Karnal. However, contrary to that, petitioner was declared Proclaimed Person on 03.10.2025 and concerned SHO was directed to take action in pursuance to the order, declaring the petitioner Proclaimed Person. Further, contends that it was on their behalf that FIR No.880, dated 03.12.2025, under Section 209 of BNS, 2023, read with Section 174-A IPC, was registered at Police Station Karnal Civil Lines, Karnal.
Learned counsel contends that, in fact, there are several orders passed by this Court, wherein, it is found that once the primary dispute is found settled, no useful purpose is served by continuing the subsidiary proceedings, such as the complaint/FIR registered under Section 174-A of the IPC.
4. Having heard learned counsel for the parties and considering the fact that the primary dispute between the parties has already been amicably settled, this Court is of the view that continuation of the present proceedings, being merely ancillary to the principal dispute, would serve no useful purpose and would amount to an abuse of the process of law. RAJAN 2026.07.15 10:01 I attest to the accuracy and integrity of this document
CRM-M-37207-2026(O&M) 3
5. Consequently, the present petition is allowed. The complaint/FIR registered under Section 174-A of the IPC, along with all consequential proceedings arising therefrom, is hereby quashed qua the petitioner.
6. However, it is made clear that if, upon examining the
contentions advanced by the petitioner before this Court, on the basis of which the present petition has been allowed at the preliminary hearing stage, respondent No.2–Shriram Finance Limited finds any such contention to be factually incorrect or misleading, it shall be at liberty to file an appropriate application seeking recall of the present order.
7. Photocopy of this order be forwarded to the complainant- respondent No.2. ( Sanjay Vashisth )
