GP FOR ENDOWMENTS The Court made the following: 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION NO: 1236 of 2026 ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: “… to issue a Writ, Order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of respondents in proposing to handover Ac.2.00 cents of land belonging to 4th respondent institution situated at 43rd Division, Vijayawada West Constituency, NTR District for construction of 150 bedded hospital as illegal and arbitrary and consequently direct the respondents not to alienate or grant permissions for construction of hospital etc., in the above said land belonging to 4th respondent institution without following due process of law..…” 2. The present writ petition is filed challenging the action of the 5th respondent in proposing to handover Ac.2.00 cents of land, belonging to the 4th respondent institution, situated at 43rd Division, Vijayawada West Constituency, NTR District for construction of 150 bedded hospital as illegal and arbitrary and violative of Articles 14, 21 and 25 of Constitution of India. 3. The learned counsel for the petitioner submitted that without acquiring the said property, either the 5th respondent or the Collector cannot allot it to any person for construction of hospital and cannot alienate the said property without prior permission of this Hon’ble High Court pursuant to direction given in the pending PIL (WP) No.11812 of 4 2005 and prayed this Court to direct the 5th respondent not to alienate the subject land to any person for construction of 150 bedded hospital. 4. The 5th respondent filed counter affidavit. In para No.10 of the counter affidavit it is asserted that there is no definite proposal to handover the 4th respondent property for construction of 150 bedded hospital. The respondent Devasthanam is also very much needed the property in 4th respondent charities which was already amalgamated in the respondent Devasthanam. It is further stated that this Hon’ble Court imposed a ban on alienation of any Endowments property without prior sanction of this Hon’ble Court in W.P.No.11812 of 2005 which is still pending. As such the present Writ Petition filed by the petitioner is nothing but a mere apprehension of the petitioner and the 5th respondent is not intending to alienate the property to the 3rd respondent. 5. Recording the said submission, the Writ Petition is closed. There shall be no order as to costs.
