20 Rkd 23.07.2026 Ct.05 W.P.A. 16333 of 2026 Debdas Haldar -vs- The State of West Bengal & Ors. Mr. Mujibar Ali Nashar, Mr. Sandip Kumar Mondal, Ms. Ritika Yadav ….for the petitioner. Mr. Atanu Baru, Mr. Piyas Choudhury ….for the State. 1. Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. In spite of service of notice private respondents are not represented. 3. It is submitted on behalf of the petitioner that present writ petition is instituted, inter alia, seeking direction upon the concerned police authorities which would permit the petitioner to enjoy peaceful possession of the land in question without any disturbance. 4. It is also submitted that certain orders were passed by the concerned Executive Magistrate but subsequent thereto no steps have been taken by the police authorities for protecting the right of the petitioner over the land in question. 5. Learned advocate representing the State respondents has filed a communication dated 20th July, 2026 of Officer-in-Charge, Kulpi Police Station and same is taken on record. Copy of the communication dated 20th July, 2026 is made over to the learned advocate representing the petitioner. 6. It is disclosed in the communication dated 20th July, 2026 that there is long standing dispute over the land in question between the petitioner and private respondents. Both are claiming their rights in connection with the said land. 7. On perusal of the communication dated 20th July, 2026, it appears that the issue involved in this writ petition is civil in nature requiring the petitioner to approach appropriate forum in order to assert his right over the land in question. 8. Police authority is not the appropriate authority to decide inter se right of the parties over the land in question. 9. Hence, this Court is not inclined to interfere with the writ petition and same stands dismissed. 10. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.) 2
