SONI SHRIVASTAVA ORAL ORDER 2 19-08-2026 Heard learned counsel for the petitioners and learned A.P.P. for the State. 2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109(1), 190, 191(2), 352 and 351(2) of the B.N.S.
3. The allegation in the F.I.R. is that the petitioners are said to have assaulted the injured person by means of brick, stone, lathi and baretha. 4. Learned counsel for the petitioners submits that the

No.57170 of 2026(2) dt.19-08-2026 2/3 narration of facts in the First Information Report itself indicates that a dispute had taken place between the neighbours and the son of the informant had only gone to the place to watch the same but he got hit by a brick which was allegedly thrown from the roof by petitioner no.2, Sharmila Devi @ Urmila Devi. With regard to others, there are general allegations of assault, however, they have not received any serious injuries. It is further submitted that a case has also been filed on the side of the petitioner against the injured persons of the present FIR and the persons on the side of the petitioners also got injured and the discharge summary of these injured persons have been brought on record by way of (Annexure-P/3).
So far as, the injury sustained by the victim, Subodh i.e. the son of the informant, is concerned, he is said to have received one grievous injury caused by hard and blunt substance but the same was only a matter of an accidental injury with no intention, as such no offence under Section 109(1) of the B.N.S is made out. 5. Learned APP for the State opposed the prayer for anticipatory bail on the basis of allegations made in the First Information Report. 6. No.57170 of 2026(2) dt.19-08-2026 3/3 case, coupled with the fact that the petitioners’ side have also sustained injury, let the above named petitioners having no criminal antecedents, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Chabilapur P.S.
