The petitioner has prayed for following relief(s):- “10.1 To call for the entire records of the case for kind perusal of Hon'ble Court. 10.2 That this Hon'ble Court may kindly be pleased to issue suitable writ against the respondents and allowed the petition. 10.3 That the Hon'ble Court may kindly be pleased to allow the writ petition and pleased to decide the Grievance of the petitioner. 10.4 This Hon'ble Court may be pleased to direct respondent R/1 Chhattisgarh Rajya Anusuchit Janjati Ayog to proceed with case which has been stop due to the hindrance caused by respondent R/2 to R/4 in the administration of justice. 10.5 This Hon'ble Court may be pleased to direct respondent R/1 Chhattisgarh Rajya Anusuchit Janjati Ayog in accordance with the law as stated in the Chhattisgarh Rajya Anusuchit Janjati Ayog 1995. 10.6 Any other relief may also be granted to the petitioners which the Hon'ble Court feels fit in the facts & circumstances of the case.” 2 Learned counsel for the petitioner submits that the petitioner had lodged a complaint before respondent No.1 alleging harassment and deprivation of his rights at the hands of respondents No.2 to 3 4. It is submitted that although the Commission had taken cognizance of the complaint, issued notices from time to time and passed various orders during the proceedings, the complaint is still pending and has not been decided till date. Learned counsel submits that the petitioner confines his prayer in the present writ petition to a limited extent and prays that respondent No.1/Ayog be directed to consider and decide the petitioner's pending complaint in accordance with law within a stipulated period. 3 Learned counsel appearing for respondent No.1 submits that the Commission has no objection if an appropriate direction is issued by this Court and assures that the petitioner's complaint shall be considered and decided expeditiously, in accordance with law, within a reasonable period. 4 I have heard learned counsel for the parties and considered the submissions made by them. 5 Considering the limited prayer made by learned counsel for the petitioner, which is not opposed by learned counsel appearing for respondent No.1, and without expressing any opinion on the merits of the petitioner's claim, this writ petition is disposed of with a direction to respondent No.1/Chhattisgarh Rajya Anusuchit Janjati Ayog to consider and decide the complaint preferred by the petitioner, in accordance with law, as expeditiously as possible, preferably within a period of 45 days from the date of receipt of a certified copy of this order. 4 6 It is made clear that this Court has not expressed any opinion on the merits of the controversy and the Commission shall decide the complaint independently, strictly in accordance with law, without being influenced by any observation contained in this order. 7 With the aforesaid observations and directions, the writ petition stands disposed of.
