Learned advocate appearing for the petitioner submits that the petitioner is in custody for six months. There is no possibility of the trial commencing very soon, as the case till date has not been committed. Learned advocate for the State has drawn the attention of the Court to the post-mortem report as well as the statement under Section 164 of the Code of Criminal Procedure of the victim. So far as the other accused is concerned, he is absconding. Having regard to the materials, which are appearing and the case is yet to be committed to the Court of Sessions. 2 At this stage, I am not inclined to release the petitioner on bail. Accordingly, CRM (M) 1429 of 2026 is dismissed. The learned Magistrate in seisin of the matter would take steps by adhering to the provisions of Section 32 of the BNSS.
