And In the matter of : Biraj Mahali ……Petitioner. Ms. Shabana Hasin Mr. Manas Kr. Das .....for the Petitioner. Mr. Kalidas Saha Mr. Amartya Mohan Bhattacharya ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than one year five months and there is no possibility of the trial concluding in near future, as such petitioner may be granted bail. On the other hand learned advocate appearing for the State submits that out of 20 witnesses cited by the prosecution in the charge-sheet 10 witnesses have been examined. I have taken into account the statement of the old lady under Section 183 of the BNSS as well as the medico legal examination report. Having considered the overall circumstances, I am of the opinion that as the trial is progressing very smoothly, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner in CRM (M) 1450 of 2026 is dismissed. 2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
