Kausik (Rejected) CRM (M) 1447 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Chanchal Police Station Case No. 664/2021 dated 14.08.2021 under Section 376D/323/324/354/509/34 of the Indian Penal Code and Section 67 of the Information Technology Act. And In the matter of : Monoranjan Murmu @ Ranjan ……Petitioner. Mr. Arup Kumar Bhowmick ……for the Petitioner. Mr. Kalidas Saha Mr. Amartya Mohan Bhattacharya ……for the State. Learned advocate appearing for the petitioner submits that some of the other accused persons have been granted bail. Present petitioner is in custody for 2 years and 4 months. Till date charges have not been framed. As such, the petitioner may be released on bail. Learned advocate for the State has produced the case diary and drawn the attention of the Court to the statement of the victim. I have taken into account the statement of the victim which places the present petitioner and other 3 to 4 persons on a completely different footing than the other accused persons who have been initially named at the top of the statement. 2 Having considered that the involvement of the petitioner allegedly in the sexual assault apart from the other overt acts which has surfaced, I am of the opinion that until and unless the evidence of the victim is over before the learned Trial Court, it would not be proper to release the petitioner on bail. As such, the prayer for bail of the petitioner in CRM (M) 1447 of 2026 is rejected. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
