Mr. Ali Ahsan Almgir Ms. Soma Mal Ms. June Modak …for the petitioners. Dr. Pradip Banerjeee Mr. Sanjib Das …for the State. Learned advocate appearing for the petitioners at the inception submits that he has instruction not to proceed with the application for bail of petitioner no. 2, namely, Khabir Hossain Sekh. However, the petitioners intend to pursue the bail application of the petitioner no. 1, namely, Habibur Rahman Sk. Learned advocate for the petitioners submits that the petitioner no. 1 is similarly situated as Md. Bisarat Munshi @ Akash Munshi, who has been granted anticipatory bail by the Hon’ble Apex Court in SLP (Crl.) No. 6409 of 2026. Learned advocate for the State opposes the prayer for bail but he is unable to refute the issue relating to parity as claimed by the petitioners. 2 Having regard to the overall circumstances, the petitioner no. 1, namely, Habibur Rahman Sk be released on bail. Thus, prayer for bail of the petitioner no. 1 is allowed. Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of learned CJM, Krishnagar, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Court and shall not leave the jurisdiction of District Nadia without the prior permission of the learned Court. Accordingly, CRM (M) 1475 of 2026 is allowed. Memo of evidence filed by the State is taken on record.
