JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused no.4 in S.C.No.226/2023 pending before the Court of II Addl. District & Sessions Judge, Mysuru, arising out of Crime No.22/2023 registered by V.V.Puram Police Station, Mysuru City, for the offences punishable under Sections 302, 201, 120B, 143, 144, 114, 75, 424, 192, 482, 485 IPC and Rule 42 of the Karnataka Prisoners Rules, 1974, read with Section 149 of IPC, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.22/2023 was registered by V.V.Puram Police Station, Mysuru City, initially for the offence punishable under Section 302 IPC against Sanju and others based on the first information dated 18.05.2023 received from Smt. Shilpa - wife of deceased Chandu. During the course of investigation, petitioner was arrested on 09.06.2023 and remanded to judicial custody. After completing investigation, charge sheet has been - 3 - HC-KAR CNR: KAHC010455122026 NC: 2026:KHC:37560 CRL.P No. 9754 of 2026 filed against 14 persons and petitioner herein is arrayed as accused no.4 in the charge sheet. His bail application filed before the Trial Court in S.C.No.226/2023 was rejected on 09.01.2026. Therefore, petitioner is before this Court. 4. Learned Counsel for the petitioner submits that except the petitioner, all other accused persons have been granted bail in the present case. In the only other criminal case which was registered against the petitioner, he has been acquitted. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP who has opposed the petition, does not dispute the submissions made by the learned Counsel for the petitioner. 6. FIR in the present case was registered against three named persons and eight others. It is not in dispute that the name of the petitioner was not found in the FIR and during the course of investigation, petitioner was arrested on 09.06.2023. The material on record would got show that test identification parade has not been held in the present case. Though CW-1, CW-29 & CW-30 are the alleged eye-witnesses, they have not - 4 - HC-KAR CNR: KAHC010455122026 NC: 2026:KHC:37560 CRL.P No. 9754 of 2026 identified the petitioner in the present case. In the only other criminal case which was registered against the petitioner, he has been acquitted. He is in custody for the last more than 2 years 3 months. All the other accused in the present case have been enlarged on bail. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 7. The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.226/2023 pending before the Court of II Addl. District & Sessions Judge, Mysuru, arising out of Crime No.22/2023 registered by V.V.Puram Police Station, Mysuru City, for the offences punishable under Sections 302, 201, 120B, 143, 144, 114, 75, 424, 192, 482, 485 IPC and Rule 42 of the Karnataka Prisoners Rules, 1974, read with Section 149 of IPC, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; - 5 - HC-KAR CNR: KAHC010455122026 NC: 2026:KHC:37560 CRL.P No. 9754 of 2026 b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
