Mr. Harendra Belwal, learned counsel for the petitioner. 2. Ms. Madhu Negi, Advocate holding brief of Mr. Lalit Samant, learned counsel for the respondent-Uttarakhand Transport Corporation. 3. Petitioner retired as Driver from Uttarakhand Transport Corporation on 30.06.2025. By means of this writ petition, petitioner has sought the following relief:- (i) Issue a writ order or direction in the nature of mandamus commanding the respondent no. 1 to release the amount Rs. 1,18,665/- in favour of the petitioner, which has been sanctioned by the respondent no. 3, towards Leave Encashment vide office letter dated 30.06.2025 (Annexure No. 4 to the writ petition). (ii) Issue a writ order or direction in the nature of mandamus commanding the respondent no. 1, to take a decision on the application moved by the petitioner dated 16.02.2026 (Annexure No. 5). 4. Learned counsel for Uttarakhand Transport Corporation, on instructions, submits that amount payable as Leave Encashment has been sanctioned, but due to financial constraints, the payment could not be released to the petitioner so far. 5. Since the liability to pay the amount is admitted by Uttarakhand Transport Corporation, therefore, the writ petition is disposed of with a direction to the 2026:UHC:2121 Managing Director, Uttarakhand Transport Corporation to ensure that the amount payable as Leave Encashment is released to the petitioner within eight weeks from the date of production of certified copy of this order. In case of failure on the party of the Corporation to release the outstanding dues within the stipulated time, the amount shall carry interest @ 9% per annum.
