1. The petitioner/wife has preferred this transfer petition under Section 24 of the Code of Civil Procedure, 1908 (henceforth 'CPC') seeking the transfer of the divorce petition filed by the respondent/husband, bearing Civil Suit No.62-A/2026 (Smt. Anju Dinkar Vs. Ajay Kumar Kurre) from the Family Court Janjgir to the competent Court of District Sarangarh-Bilaigarh.

2 compelled to leave the matrimonial home. He further submits that the petitioner is permanent resident Village Budgahan, Police Station Baloda, District Janjgir-Champa, however, present she is residing at Sarangarh- Bilaigarh due to her posting as Mandi Inspector therein. But, respondent/husband has filed divorce petition in Family Court Janjgir- Champa. He further submits that petitioner is unable to travel to the Family Court Bilaigarh-Sarangarh for every hearing due to the distance of approximately 200 kilometers to and fro. He also contends that it is a well- settled position of law that the convenience of the wife must be kept paramount while considering a transfer petition. Therefore, it is prayed that the transfer petition may be allowed. 3. On the other hand, learned counsel for the respondent opposes the prayer made by the petitioner and submits that there is direct bus and train connectivity between the two places, and the distance is not too far. He further submits that petitioner is well educated Government servant and posted as Mandi Inspector whereas the respondent/husband is Assistant Grade-III at the office of CSEB Akaltara. In such circumstances, this petition may be rejected. 4. I have heard the learned counsel for the parties and perused the material placed on record. 5. Having considered the rival submissions of the parties and perused the record, it is undisputed that the petitioner aged about 33 years is employed as a Mandi Inspector and currently residing at Sarangarh-Bilaigarh, while the respondent is working as an Assistant Grade-III at Akaltara. The distance between Janjgir and Sarangarh-Bilaigarh is approximately 100 kilometers, which is well connected by regular public transport. While the convenience
3 of the wife is a relevant factor in transfer applications arising out of matrimonial disputes, it is not an absolute rule, particularly when the wife is an independent, financially sound and gainfully employed government officer capable of traveling without financial or logistical hardship. Hence, this Court does not find any sufficient ground to transfer the case. 6. Accordingly, the transfer petition is rejected. 7.
However, the concerned Family Court shall expedite the trial and conclude the proceedings expeditiously and the parties are directed to cooperate with the Family Court for an early and efficacious disposal of the case. 8. Moreover, the petitioner/wife shall be at liberty to join the proceedings before the concerned Family Court through video conferencing on dates when her personal appearance is not explicitly required by the court. 9.
