Accused no.1 in Crime No.125/2026 registered by Gubbi Police Station, Tumakuru District, for the offences punishable under Sections 115(2), 118(1), 351(2), 3(5), 352, 324(2) *& 109 (1) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.125/2026 was registered by Gubbi Police Station, Tumakuru District, for the aforesaid offences against the petitioner and others based on the first information dated 11.04.2026 received from Balaji.P.M., who is the injured victim in the present case. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.676/2026 before the jurisdictional Sessions Court, which was rejected on 07.05.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that in respect of the alleged incident that had taken place on 11.04.2026, there is a case and counter case registered by Gubbi Police Station in Crime Nos.125/2026 & 127/2026. The *Corrected vide Court Order dated:21.07.2026 - 3 - HC-KAR NC: 2026:KHC:35526 CRL.P No. 7971 of 2026 coordinate bench of this Court has granted anticipatory bail to accused nos.2 & 3 in Crl.P.No.7182/2026 disposed of on 21.05.2026. It is not in dispute that the alleged victim has suffered only simple injury in the incident in question. It appears that there is some civil dispute between the parties. Undisputedly, petitioner has no other criminal antecedents. Under the circumstances, I am of the opinion that petitioner's prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order: 5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.125/2026 registered by Gubbi Police Station, Tumakuru District, for the offences punishable under Sections 115(2), 118(1), 351(2), 3(5), 352, 324(2) *& 109 (1) of BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. *Corrected vide Court Order dated:21.07.2026 - 4 - HC-KAR NC: 2026:KHC:35526 CRL.P No. 7971 of 2026 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3.
