( 2026:JHHC:9890 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 2152 of 2026 ------ Prakash Bhuiyan @ Prakash Kumar, aged about 24 years, S/o Ganesh Bhuiyan @ Ganesh Ram, R/o Village –Ranchi Road, Redma, P.O. –South Redma, P.S. –Daltonganj, District – Palamau, Jharkhand. … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Sheo Kr. Singh, Advocate For the State : Mr. Gautam Rakesh, Addl. P.P. ------ Order No.03 Dated- 07.04.2026 Heard the parties. The petitioner has moved this Court for grant of bail in connection with Daltonganj Town P.S. Case No.380 of 2022 corresponding to S.T. Case No. 207 of 2023 registered for the offences punishable under sections 147, 148, 149, 341, 342, 323, 324, 307 and 34 of the Indian Penal Code and under Section 27 and 35 of the Arms Act. The learned counsel for the petitioner submits that this is the fourth journey of the petitioner with the prayer for regular bail and earlier the prayer for regular bail of the petitioner was rejected thrice by a Co-ordinate Bench of this Court. It is further submitted that the fresh ground is that in the meanwhile, two more witnesses i.e. P.W.4 and P.W.5 have been examined out of which P.W.4 is a seizure witness and P.W.5 has stated that the brother of the petitioner is threatening to kill him. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. on the other hand vehemently opposes the prayer for bail and submits that keeping in view the conduct of the petitioner that when he is still in jail custody, he is threatening the P.W.5 through his brother, there is every chance of the petitioner tampering with the evidence and absconding, if released on bail. Hence, it is submitted that the petitioner ought not to be admitted to bail. Considering the serious nature of allegation against the petitioner and his conduct by indulging in threatening the P.W.5 through his brother, as also the chance of his absconding and tampering with the evidence, if released on bail, as well as the fact that his prayer for regular bail has already been rejected thrice on merit, this Court is not inclined to admit the above-named petitioner on bail. Accordingly, the prayer for bail of the above-named petitioner is rejected for the same reasons as mentioned in the order dated 17.08.2023, passed in B.A.6162 of 2023.
