Learned Advocate appearing for the petitioner submits that petitioner was arrested on 24th August, 2019 and since then he is custody. Earlier the prayer for bail of the petitioner was rejected but with certain observations, till date the trial could not be completed and the cross- examination of the investigating officer is in progress. Learned Advocate submits that there are some defense witnesses which the defense may tender after the examination of the accused persons are completed under Section 313 of the Code of Criminal Procedure. 2 2. Learned Advocate for the State expresses inability to pursue the police authorities to produce the Case Diary. 3. I have taken into account the period of detention of the present petitioner only which is six years eleven months. Having considered the same and without entering into the merits of the case I am inclined to release the petitioner on bail. 4. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Li Wan Tho shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Additional Chief Judicial Magistrate, Sealdah. 5. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of Kolkata Municipal Corporation without prior permission of the learned Trial Court. 6. With the aforesaid observation, C.R.M (M) 1459 of 2026 is allowed. 7. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court. 8. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
