ORAL ORDER Learned High Court Government Pleader takes notice for respondent Nos.1 to 5. Notice to respondent Nos.6 and 7 is not necessary for the following reasons. 2. Learned High Court Government Pleader raises a preliminary objection that the prayer in the writ petition is to issue a writ of mandamus directing respondent No.2-Deputy Commissioner and respondent No.3-Assistant Commissioner to take action to set aside the mutation entry in M.R.No.7/1998- 99, as the same is illegal. 3.
Learned High Court Government Pleader submits that the remedy for the petitioner is before the Assistant Commissioner in terms of Section 136(2) of the Karnataka Land Revenue Act, 1964 (for short, "KLR Act, 1964"). The petitioner has indeed approached the Assistant Commissioner by filing an

appeal under Section 136(2) of the KLR Act, 1964, in proceedings bearing No.RA.129/2025 and the Assistant Commissioner passed an order on 16.09.2025 rejecting the appeal while directing the petitioner to approach a competent Civil Court to redress his grievance. He further submits that the petitioner should have either challenged the order passed by the Assistant Commissioner under Section 136(3) of the KLR Act, 1963, before the Deputy Commissioner or the petitioner should have approached the competent Civil Court. 4. There is substance in the submission made by the Learned High Court Government Pleader. 5. Accordingly, the writ petition stands disposed of, reserving liberty to the petitioner to either file a revision petition before the Deputy Commissioner if he is aggrieved of the order passed by the Assistant Commissioner or approach a competent Civil Court to get a declaration of title.
