Heard Shri M. Hossain, learned counsel for the petitioner. Also heard Shri B.J. Talukdar, learned State Counsel and Ms. N. Bordoloi, learned Standing Counsel, Revenue Department. The present case has been filed with a relief seeking compensation for acquisition of land.
For ready reference the prayer made in the petition is extracted herein below:
“Under the above circumstances it is prayed that Your Lordships would be pleased to admit this Petition, call for the records, issue rule calling upon the respondents to show cause as to why a writ in the nature of mandamus or any other appropriate writ or order (s) or direction shall not be issued directing the Respondent Authorities to include the name of the petitioner in respect of lands under Dag No. 148, 149 & 150 situated at Village- Bhoktabari in the list of beneficiaries of compensation by assessing land value and zirat as compensation of land and to pay compensation to the petitioner or to pay compensation as per The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and on perusal of records and reply to show cause if any after hearing the parties would be pleased to make the rule absolute by directing the respondent authorities to include the name of the petitioner in the list of beneficiary of compensation and to pay compensation for the scheduled land of the petitioner or to pay compensation as per The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and / or pass
Page No.# 3/3 any other order/ orders, directions as your Lordships may deem fit and proper for the interest of justice. And for which act of your kindness your humble petitioner as in duty bound shall ever pray.”
A careful examination of the materials on record including the Annexures would not show a single document of connection of the petitioner with the land in question. Rather, the communication dated 30.09.2024 by the Lat Mandal has, to the contrary confirmed that there is no possession of the petitioner. At this stage, the learned counsel for the petitioner submits that the family members may be given liberty to approach this Court.
After a consideration of the same, the writ petition is dismissed, however with a liberty to the family members to approach this Court. JUDGE Comparing Assistant
