Kausik (Rejected) CRM (M) 1446 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Ballygunge GRPS Police Station Case No. 24 of 2025 dated 15.10.2025 under Sections 118(2)/109(1)/3(5) of BNS, 2023. And In the matter of : Sk. Kabir Ali @ Kobir Ali ……Petitioner. Mr. Mir Md Hasanuzzaman Mr. Samiul Haque ……for the Petitioner. Dr. Pradip Banerjee, APP Ms. Shalu Gupta ……for the State. The earlier order passed in CRM (M) 26 of 2026 reflects that direction was passed to complete the evidence of the injured within a period of 5 months. Submissions of the learned advocate for the petitioner as well as the State reflect that such order was communicated in the month of March, 2026. Accordingly, learned Trial Court would complete the evidence of one injured witness by 31st August, 2026. Learned Trial Court will not grant any adjournment to either of the parties and ensure the evidence is completed by the schedule date. 2 Petitioner would be at liberty to approach this Court after the aforesaid evidence is over. At this stage, CRM (M) 1446 of 2026 is dismissed. Mr. Pradip Banerjee, learned APP and Ms. Shalu Gupta, learned advocate appear on behalf of the State. Their appointment may be regularized by the concerned authorities. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
