And In the matter of : Atuyari Sk @ Atuyari Sk @ Etowari @ Atoyori Sk. ……Petitioner. Mr. Arup Sarkar Mr. Sourav Mukherjee Mr. Gourav Roy .....for the Petitioner. Mr. Gouranga Kumar Das, Ld. APP Ms. Priti Kar Bagchi ……for the State. Learned advocate appearing for the petitioner submits that other accused persons have been granted anticipatory bail by the learned Sessions Judge and petitioner is similarly placed. On the other hand learned advocate appearing for the State submits that it is the petitioner who inflicted the fatal blow. I have taken into account the Sessions Court’s order which also reflects regarding the complicity of the present petitioner and refused the anticipatory bail application. Perusal of the Case Diary reflects that the petitioner is not similarly situated as the other accused. Accordingly, the prayer for anticipatory bail of the petitioner in CRM (A) 1899 of 2026 is dismissed. 2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
