JUSTICE ALOK KUMAR ORAL ORDER 3 17-08-2026 Heard learned counsel for the petitioner, learned counsel for the victim and the learned A.P.P. for the State. 2. The petitioner seeks regular bail in connection with Singheshwar P.S. Case No. 137 of 2026 lodged on 08.04.2026, for the offences punishable under Sections 64(1), 98, 99, 70(2), 61(2)(a), 143(2), 144(2), 144(1), 111, 3(5) of the Bharatiya Nyaya Sanhita, under Sections 3, 4, 5, 6, 7 of ITP and under Sections 4, 8, 12 of POCSO Act. 3. As per the prosecution, F.I.R has been lodged against 13 named as well as unknown accused persons with allegation that they were doing business of prostitution. The raid has been made by the raiding team under the leadership of the Patna High Court CR. MISC. No.45876 of 2026(3) dt.17-08-2026 2/3 DSP’s Headquarter. During the raid, some of the accused persons were arrested including the petition herein. 4. The learned counsel for the petitioner submits that the petitioner is innocent and nothing to do with the alleged crime. Learned counsel for the petitioner further submits that the criminal antecedents of the petitioner are clean and he is in custody since 09.04.2026. The learned counsel lastly submits that other co-accused has already been granted bail by a co- ordinate Bench of this Court vide order dated 11.08.2026 passed in Cr. Misc. No. 48201 of 2026. 5. The learned APP for the State vehemently opposed the prayer for bail of the petitioner. 6. Having heard the parties and taking into consideration that there is general and omnibus allegations against the petitioner and taking into account the order passed by a co-ordinate Bench of this Court in which other co-accused has already been granted bail, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the likewise amount each to the satisfaction of learned District & Additional Session Judge- VI-cum-Special Judge, POCSO, Madhepura in connection with Singheshwar P.S. Case No. 137 of 2026, subject to the following Patna High Court CR. MISC. No.45876 of 2026(3) dt.17-08-2026 3/3 conditions: (I) One of the bailors shall be the petitioner's own or close family member. (II) The petitioner shall co-operate in the process of trial. (III) The petitioner shall not tamper with the prosecution evidence or influence/intimidate any witness during the course of trial. (IV) The Petitioner shall not commit offence of a similar nature in future. In case of violation of any of the aforesaid conditions, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner. Bipin/- (Alok Kumar, J) U T
