SIDE) for R1 ORDER The petitioner / accused facing trial in C.C.No.39 of 2025 for the offence punishable under Section 294(b), 448, 506(ii) IPC, had filed this quash petition. 2. The contention of the petitioner is that the second respondent / de facto complainant is not an injured person and had falsely projected a case as though she is injured and a case in Cr.No.80 of 2022 registered against the petitioner. The respondent police has not considered that the petitioner had given a counter complaint and it is a nature of “case in counter” and not followed PSO 566 and the Full Bench decision of this Court. Hence filed this quash petition. 3. The learned Counsel for the Government of Tamil Nadu (Criminal Side) submitted that the respondent police have followed PSO 566 and investigated both the cases and filed charge sheet in the counter case in https://www.mhc.tn.gov.in/judis CRL OP No. 14108 of 2026 __________ Page3 of 5 C.C.No.211/2024. Both the cases are being posted together and tried simultaneously but separately and the cases are posted for trial on 08.06.2026 and summons have been issued for appearance of L.W.1 to L.W.5. In both cases charge sheet has been filed and it is for the trial Court to decide the same during trial. 4. In view of the above, this Court is not inclined to entertain this petition. The trial Court is directed to conduct the trial in both the cases simultaneously but separately and render judgment on the same day. The observations made in this case is only for the limited purpose of deciding this case. The trial Court to proceed with the trial on its own merits. 5.
