Learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated in the instant case and the other accused persons have been granted bail. Learned advocate for the State has referred to the injury report of Chattar Molla wherein I find that 4-5 centimeters of incised wound over frontal region of the head along with other injuries. The statement of said Chatter Molla reflects that it is the present petitioner who inflicted the injuries with the aid of iron rod. Charge-sheet has been submitted before the jurisdictional court. As such, I am of the opinion that this is not a fit case for granting anticipatory bail of the petitioner. If the petitioner appears and surrenders before the jurisdictional court, the jurisdictional court on an application for bail filed by the 2 petitioner will independently consider the prayer for regular bail without being influenced by any observations made by this Court. Accordingly, CRM(A) 1978 of 2026 is dismissed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
