The petitioner is aggrieved by non-grant of electricity supply to the petitioner’s residential premises despite having paid the requisite amount. 2. Mr. Mukherjee, learned advocate appearing for the respondent CESC authority submits that CESC Limited is ready and willing to effect supply in favour of the petitioner. However, CESC could not do the work in view of stiff resistance that was put up by the respondent nos. 4, 5 & 6. It is submitted that the meter board is also locked. 3. Learned Advocate appearing for the respondent nos.4, 5 & 6 submits that the said respondents do not have any objection, in principle, to the grant of electricity supply to the petitioner. They, however, have a serious objection at the meter being installed on the meter board where the respondent nos.5 & 6’s meters are installed. 2 4. Mr. Mukherjee, learned advocate appearing for the CESC authority submits that meters are ordinarily installed at the existing meter board position i.e. at the same place where the service connection comes out in the relevant premises. It is submitted that in case separate meters are to be installed at different places in the same premises, the same would cause safety issues inter alia due to multiplicity and criss-crossing of wires. 5. Having heard the learned advocate appearing for the respective parties and having considered the materials on record, this Court is of the view that the respondent CESC authority should be directed to effect electricity supply in favour of the petitioner at the premises by installing the meter at the existing meter board position. 6. The specific stand taken by the CESC authority that installing separate meters at different places while having service connection at one place in the same premises would be risky has not been dislodged by the private respondents. Therefore, this Court cannot risk life and property by directing installation of meter at a place other than the existing meter board. 7. The private respondents are restrained from creating any obstruction or putting up any resistance in CESC authority’s execution of the work of effecting electricity supply in terms of this order. 3 8. In case the electricity authorities face any resistance, the CESE authorities shall be free to approach the Officer-in-Charge Watgunge Police Station seeking Police assistance. If any, request is made by the CESC authority for the purpose of Police assistance, the Officer-in-Charge, Watgunge Police Station render appropriate police assistance to the CESC authorities to enable them to execute the job of effecting supply in favour of the petitioner. Costs of such Police assistance would be borne by the petitioner. 9. In case there is any padlock on the meter room the Police authorities would be entitled to break open the same to enable the CESE authorities to effect supply upon installing the meter. It is made clear that padlocks put up only on the meter board position would be broken, if required, in terms of this order and nowhere else. The entire exercise will be carried out by CESE Ltd. within three weeks from date. 10. With the aforesaid observation WPA 16189 of 2026 stands disposed. No costs. (Om Narayan Rai, J. )
