And In the matter of : Sukdeb Sadhu @ Suk & Ors. ……Petitioners. Mr. Angshuman Chakraborty Ms. Deblina Mondal ……for the Petitioners. Mr. Pinaki Bhattacharyya, Sr. Govt. Adv. Mr. Amartya Mohan Bhattacharyya ……for the State. Learned advocate appearing for the petitioner submits that the incident complained of is of the year 2015. The petitioners have been roped in as they are sympathizers of a particular political party and the case has been initiated after the election results were declared. Learned advocate for the State opposes the prayer for anticipatory bail and submits that there are antecedents of the present petitioners. Be that as it may, so far as the facts of the present case is concerned, this refers to an incident of more than 11 years 2 ago. Having regard to the same, I am of the opinion that although a case has been made out for investigation but custodial detention of the present petitioners may not be warranted in the facts and circumstances of the case. As such, I direct that in the event of arrest, the petitioners namely, (1) Sukdeb Sadhu @ Suk, (2) Narayan Ghosh @ Nantu, (3) Tapas Das @ Apu be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress, petitioner shall meet with the Investigating Officer within a period of 10 days from date and shall thereafter continue to meet with the Investigating Officer as and when fixed by the Investigating Officer of the case. Accordingly, CRM (A) 1950 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
