Mr. Uday Sankar Chattopdhyay Ms. Trisha Rakshit Ms. Aishwarya Datta Ms. Sadia Parveen … for the petitioner(s) Mr. Pritom Banerjee … for the State-respondent(s) Learned Senior advocate appearing for the petitioners refers to the accusations made in the complaint which was addressed to the Officer-in-charge of Pragati Maidan Police Station on or about 31.05.2026 which was initiated against the present petitioners including the Councilor of Ward No. 57 of the area. The foundational facts of the said FIR relates to an incident of 2021. Learned advocate for the State opposes the prayer for bail and refers to the different statement which have been collected. 2 I have taken into account the materials and I find that although there were information being sent to the concerned authorities including the police authorities, but, no action was taken. Having regard to the fact particularly the period of time which has elapsed and the petitioners having the permanent residences as also the fact that chances of absconsion being remote, I am of the view that custodial detention of the present petitioners may not be warranted in the facts and circumstances of the present case. Hence, the prayer for anticipatory bail of the petitioners is Allowed. Accordingly, I direct that in the event of arrest, the petitioners [Suman Saha, Debasis Makal, Biswanath Makal, Jiban Saha] be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioners shall meet with the investigating officer of the case as and when called for by the Investigating Officer 3 and shall leave the jurisdiction of the State of West Bengal after taking permission of the jurisdictional court.
