The petitioners are apprehending their arrest in connection with Complaint Case No. 1925 of 2023, registered for the offence under Sections 26(1)(g)(d)(f)(h), 41, 42, 52 Indian Forest Act (Bihar Amendment Act, 1989) and Sections 27, 29, 31 and 51 of Wild Life Protection Act, 1972 pending in the court of learned Chief Judicial Magistrate, Koderma.

Learned counsel appearing for the petitioners submits that the false allegations are made against the petitioners of collecting and mining of blue stones from the forest area. He submits that the petitioners are labourer and only on suspicion, the petitioners have been implicated. He further submits that other co-accused has been granted anticipatory bail in A.B.A. No.7452 of 2025.

Learned Special P.P. appearing for the State has opposed the prayer and submits that the petitioners are having criminal antecedents.

Considering that the name of petitioners has come only on suspicion and other co-accused has been granted anticipatory bail, in granting anticipatory bail or regular bail, criminal antecedents can be one of the criteria, however, cannot be a sole criteria of either rejecting or allowing the anticipatory bail or regular bail and that the name of the petitioners has come only on suspicion, and in that view of the matter, the petitioners, named above, are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
