The present writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for quashing impugned promotion order dated 01.03.2019 (Annexure P5) vide which persons junior to the petitioner has been promoted to the post of TGT Sanskrit without preparing seniority list and petitioner’s claim has been rejected vide impugned order dated 13.06.2023(Annexure P12). 2. Learned State counsel at the outset submits that the grievance raised by the petitioner is substantially redressed as vide order dated 19.06.2026, he has been promoted as TGT Sanskrit w.e.f. 01.03.2019 and upon promotion he has been transferred to Yamunanagar. Copy of order dated 19.06.2026 is produced in Court today, which is taken on record and mark as Mark ‘X’. Registry is directed to tag the same at appropriate place. Learned counsel for the petitioner, however, submits that his grievance regarding the finalization of the seniority list still subsists. Moreover, amendment in the Haryana School Education (Group-C) State Cadre Service Rules, 2023 cannot be applied retrospectively for denying promotion to the petitioner as his claim has to be considered under rule 9(2) of the Haryana School Education (Group-C) State Cadre Service Rules, 2012 (for short, ‘2012 Rules’) (Annexures P1 and P2) prevailing at that time. Learned counsel further submits that promotions in the year 2019 were made in violation of rule (2) of the 2012 Rules without finalization of the Seniority List. 4. At this stage, learned counsel for the petitioner prays for the issuance of directions to the respondent-authorities to consider and redress the petitioner’s grievance concerning the seniority list in accordance with the 2012 Rules and to pass an appropriate speaking order after affording an opportunity of hearing to the petitioner. 5. In view of the above, present petition is disposed of with a direction to respondent No.2/competent authority to consider and decide the grievance of the petitioner regarding finalization of seniority list in terms of rule 9(2) of the Haryana School Education (Group-C) State Cadre Service Rules, 2012 by passing a reasoned and speaking order, in accordance with law, within a period of three months from the date of receipt of a certified copy of this order. 6. It is further directed that the decision so taken shall be communicated to the petitioner.
