JUSTICE SANDEEP KUMAR ORAL ORDER 3 07-08-2026 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. 2. The petitioner seeks regular bail in connection with S.Tr. No. 519 of 2026 arising out of Punpun P.S. Case No. 351 of 2025, registered for the offence under Sections 103(1) & 238(a) of the B.N.S. 3. As per the prosecution case, body of the deceased was recovered and F.I.R. against unknown persons was registered. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner’s name emerged during the investigation based on a statement given by Rani Kumari, which alleges that the petitioner and another co-accused conspired before the deceased Patna High Court CR. MISC. No.38877 of 2026(3) dt.07-08-2026 2/2 was killed by Arvind Mahto and Ganni Mahto with Punam Kumari, who was acting as a conspirator. The petitioner also reportedly made a self-inculpatory statement. The petitioner is in custody since 18.12.2025 having clean antecedent. 5. Learned A.P.P. for the State has vehemently opposed the prayer for bail and submits that it is a case of murder and individuals involved in such offences should not be granted bail. 6. Considering the gravity of offence, I am not inclined to grant bail to the petitioner. 7. Accordingly, this application is dismissed. 8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner. sadique/- (Sandeep Kumar, J) U T
