The petitioner is apprehending his arrest in connection with Thakur Gaon PS Case No.71 of 2025, for offence registered under section 303(2), 317(5) of BNS, 2023 and Section 4 and 21 of Mines and Minerals (Development and Regulation) Act, 1957, Rules 4 and 54 of Mines and Minerals Concession Rules, 2017, pending in court of learned Civil Judge(Senior Division) XIX-Cum-Judicial Magistrate-XX, Ranchi. 3. Learned counsel for the petitioner submits that the petitioner is the owner cum driver of the tractor and 100 cft sand was loaded on the said tractor. He next submits that the petitioner has got no criminal antecedent as disclosed in paragraph no. 9. 4. Learned State counsel opposes prayer and submits that illegally the said sand was being loaded on the said tractor. 5. Considering that the petitioner is the owner cum driver of the tractor and the petitioner has got no criminal antecedent as disclosed in paragraph no.9, and in that view of the matter, the petitioner, above named, is, hereby, directed to surrender before learned court within two weeks from today, and learned court shall release the petitioner, above named, on such terms and conditions as well as sureties as the learned court may deem fit and proper. 6.
