Learned advocate appearing for the petitioner submits that petitioner is similarly placed as the other accused person who has been granted bail in CRM (M) 759 of 2026. Learned advocate for the State opposes the prayer for bail. Learned advocate for the defacto complainant also opposes the prayer for bail and submitted that it was the 2 present petitioner from whom the offending bamboo was recovered. I have taken into account the overall circumstances and the genesis of the dispute and the petitioner being on similarly situated as the other accused person who have been granted bail. Accordingly, petitioner be released on bail by the learned Trial Court as the other accused namely, Praloy Saha @ Pralay Saha in CRM (M) 759 of 2026 on same conditions. As such, CRM (M) 1443 of 2026 is allowed. Mr. Pradip Banerjee, learned APP and Mr. Sankalpa Bhattacharjee, learned advocate appear on behalf of the State. Their appointment may be regularized by the concerned authorities. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
