The Chief Manager, Bank of Baroda and others Versus Digambar Behera
Mr. Digambar Behera … appellant/respondent in person.
Mr. Soumya Majumder, Sr. Adv. Mr. Dipanjan Datta, Mr. Subhajit Chowdhury, Ms. Esha Basak … for the Bank.
1. The affidavit-in-opposition is being filed by the respondent/appellant in MAT 764 of 2026. The same is taken on record.
2. The affidavit-in-reply to MAT 971 is taken on record. Re: MAT 764 of 2026
3. The writ petitioner/appellant wants to submit that his submission has wrongly been recorded in paragraph 47 of the order passed by the learned Single Judge.
4. In these circumstances, we are of the view that an appeal is not the appropriate remedy as it was for the petitioner/appellant to point out such fact to the learned Single Judge, if there is a wrong recording of his submission.

5. Being faced with such observation of the court, the appellant in person submits that he will avail remedy of review before the learned Single Judge.
6. The party in person submits that the issue of limitation may arise against him while preferring an application for review. We only observe that it would be open to the petitioner/appellant to raise an issue regarding pendency of the present appeal to meet the issue of review, which is left to be considered by the learned Single Judge.
7. With liberty as prayed for, we disposed of the present appeal.
Re: MAT 971 of 2026
8. In view of the order passed today in the connected appeal (MAT 764 of 2026), the present appeal will have to await consideration of the review proposed to be filed before the learned Single Judge.
