JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners call in question the proceedings in C.C.No.497/2023 registered for an offence punishable under Sections 323, 507, 498A, 504, 149 and 506(2) of the Indian Penal Code, 1860 ('the IPC' for short) and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Heard Sri. Dastagir J.A., learned counsel appearing for the petitioners, Smt. Rashmi Patel, learned High Court Government Pleader appearing for respondent No.1 and have perused the material on record. - 4 - HC-KAR NC: 2026:KHC:35459 CRL.P No. 8197 of 2026 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and the memorandum of settlement reads as follows: “MEMORANDUM OF COMPROMISE PETITION UNDER ORDER XXIII RULE 3 OF THE CODE OF CIVIL PROCEDURE. c) The plaintiff had filed a complaint regarding the allegation of Section 498A of the IPC, before the Nagamangala Town Police Station, against the defendant and his family members. Based on the plaintiff's complaint, the Nagamangala Town Police sections 143, 323, 504, 506(2), 498A, and 507 of IPC, and registered Crime No. 63/2022 for offences punishable under read with sections 3 and 4 of the Dowry Prohibition Act. Subsequently, due to the location of the incident, the case was transferred to the Turuvekere Police Station, where Crime No. 139/2022 was registered. After investigation, a charge sheet was filed for offences punishable under sections 498A, 504, 506(2), 507, and 149 of IPC and sections 3 and 4 of the Dowry Prohibition Act. The same has been numbered as C.C. No. 497/2023, pending before the Senior Civil Judge and JMFC at Turuvekere. The plaintiff, through this compromise, shall withdraw the entire allegation made against the defendant and his family members and support the closure of C.C. No.497/2023, pending before the Senior Civil Judge and JMFC at Turuvekere. d) The plaintiff had filed Crl. Misc. Petition No. 692/2023, before the Senior Civil Judge and JMFC at Nagamangala, under section 12 of the Domestic Violence Act. The plaintiff shall withdraw the same and shall not claim any maintenance in the future. e) Both parties are at liberty to marry whomever they wish, in the future. - 5 - HC-KAR NC: 2026:KHC:35459 CRL.P No. 8197 of 2026 4. Both parties are dissolving the marriage solemnized between them on 26.11.2020, at MBS Convention Hall, Mysuru Road, Nagamangala Town, as per the customs of the Mohammedan faith by way of this compromise. 5. All the parties have signed this agreement by voluntarily agreeing to the above terms, without any force or coercion from anyone. WHEREFORE, the plaintiff and defendant most humbly pray that this Hon'ble Court may be pleased to decree the suit in terms of the compromise petition, in the interest of justice and equity." 4. In light of the settlement arrived at between the parties as afore-quoted, I pass the following: ORDER (i) Criminal Petition is allowed.
