Learned advocate for the petitioner submits that the petitioner is innocent of the charges and he has been falsely implicated in connection with the instant case. Learned advocate for the State opposes the prayer for anticipatory bail. I have taken into account the case diary with regard to the accusations under Section 111 of the BNS and, I find that the said provision do not apply so far as the present petitioner is concerned.
2 Having considered the nature of the complaint, I am of the opinion that although a case for investigation has been made out, but, I am inclined to grant anticipatory bail to the present petitioner. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Bidhan Debnath @ Bidhan Chandra Debnath] be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioner shall meet with the investigating officer of the case as and when called for by the Investigating Officer. Accordingly, CRM (A) 2042 of 2026 is disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
