Kausik (Rejected) CRM (M) 1442 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Rampurhat Police Station Case No. 169 of 2022, dated 22.03.2022 under sections 147/148/149/325/326/307/302/435/436/327 of IPC. And In the matter of : Samir Sk ……Petitioner. Mr. Samrat Banerjee ……for the Petitioner. Mr. Amajit De, Special PP, CBI ……for the CBI. Learned advocate appearing for the petitioner submits that petitioner is in custody for 4 years and 3 months and out of 142 witnesses cited in the charge sheet, prosecution, till date has examined 41 witnesses. Petitioner has taken up the plea that he is suffering from cancer. Learned advocate for the CBI has opposed the said contention and submitted that petitioner is suffering for fluctuations in pressure and there are certain anomalies which have been detected by the medical practitioners of S.S.K.M. so far as his recovery is concerned. The plea of cancer taken up by the petitioner has been completely denied by the prosecution from the medical reports enclosed. Emphasis has been made in respect of another accused who was granted bail because he 2 was suffering from cancer. Petitioner is not on parity with the said other accused persons. Learned advocate for the petitioner has stressed on the issue relating to delay in trial. The present case is one of the exceptional cases where more than 10 persons including children were charred to death and the prosecution materials which are appearing shows involvement of the petitioner as a leading offender. Having regard to the totality of the circumstances and the steps which are being taken so far as medical care of the petitioner is concerned along with the gravity of the offence which makes out the case as one of the rarest cases, I am not inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner in CRM (M) 1442 of 2026 is dismissed. Report submitted by the CBI be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
