Accused in Crime No.172/2025 registered by Chamarajanagar Town Police Station, Chamarajanagar, for the offences punishable under Sections 305, 331(4), 62, 326(g) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.172/2025 was registered by Chamarajanagar Town Police Station, against the petitioner herein for the aforesaid offences based on the first information dated 06.09.2025 received from Sami Ulla S/o late Anwar Sharif. In the said case, petitioner was arrested on 06.09.2025 and remanded to judicial custody. After completing investigation, charge sheet has been filed for the aforesaid offences. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.491/2025 was rejected on 01.12.2025. Perusal of the material on record would go to show that on the intervening night of 05.09.2025 and 06.09.2025, petitioner who had consumed alcohol had gone to New Taj Hotel at Chamarajanagar Town, to consume food. CW-3 had refused to provide him food for the reason that he had consumed alcohol. Thereafter, he had gone to a nearby Masjid and CW-1 & CW-2 had refused entry to the Masjid for the reason that petitioner had consumed alcohol. It is in this background, subsequently, petitioner had committed theft of jerkin belonging to CW-3 and also lit fire to certain papers and other articles inside the Masjid and had caused loss to the tune of Rs.10,000/-. 5. Petitioner has been arrested in the present case on 06.09.2025. Undisputedly, he has no criminal antecedents. Investigation of the case is completed and charge sheet has been filed. Considering the aforesaid aspects of the matter and the allegations found as against the accused in the charge sheet, I am of the opinion that petitioner's prayer for grant of - 4 - HC-KAR CNR: KAHC010391542026 NC: 2026:KHC:37558 CRL.P No. 8221 of 2026 regular bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.172/2025 registered by Chamarajanagar Town Police Station, Chamarajanagar, for the offences punishable under Sections 305, 331(4), 62, 326(g) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said - 5 - HC-KAR CNR: KAHC010391542026 NC: 2026:KHC:37558 CRL.P No. 8221 of 2026 Court until the case registered against him is disposed off.
