Kausik (Allowed) CRM (A) 1951 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bongaon Police Station Case No. 324 of 2026 dated 03.05.2026 under section 115(2)/126(2)/3(5)/35(3) of the BNS, 2023. And In the matter of : Narayan Ghosh @ Nantu ……Petitioner. Mr. Angshuman Chakraborty Ms. Deblina Mondal ……for the Petitioner. Mr. Subrata Mukharjee Mr. Sanjib Das ……for the State. Learned advocate appearing for the petitioner submits that petitioner is the people’s representative of the local area who has been implicated in the present case on the accusation of slapping and threatening to kill the complainant. Learned advocate for the State opposes the prayer for bail and submits that there are antecedents of the petitioner. The report reflects that petitioner had cases from the year 1987 till 2024. There are cases which include Section 302 of the IPC as well as under the Arms Act. I have taken into account the merits of the case as also the injury report which has been enclosed in the present case. 2 Having regard to the same, I am of the view that custodial detention of the petitioner is unwarranted. As such, prayer for anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioner namely, Narayan Ghosh @ Nantu, be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Petitioner shall not enter the jurisdiction of Bongaon Police Station except for the purposes of attending the Investigating Officer of the case once in a week and for the purposes of attending the Court. Accordingly, CRM (A) 1951 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
