27. 23.07.2026. Court No.05.
(Pritam)
WPA 16546 of 2026.
Kuddus Ali Seikh & Anr. -Vs.- State of West Bengal & Ors.
Mr. S.S. Arefin, Ms. Anamika Jana.
......for the petitioners.
Mr. Suryaneel Das, Ld. AGP., Ms. Anita Kundu, Mr. Amit Kr.Roy.
......for the State.
1. Affidavit-of-service filed on behalf of the petitioners is taken on record.
2. Learned advocate representing the petitioners submits that in spite of order passed by the Hon’ble Division Bench on 18th October, 2001 on a writ petition being WPLRT 1177/2001, Superintendent of Police, Burdwan has passed an order on 16th August, 2002. According to the petitioners, such order ought not to have been passed by the jurisdictional Superintendent of Police dated 16th August, 2002.
3. State respondent is represented by learned advocate.
4. It is found that after passing of order by the Superintendent of Police, which prompts the petitioners to approach this Court with the present writ petition, precisely 24 years have passed and there were no contemporaneous steps taken by the
2 petitioners against such order dated 16th August,
2002. Due to efflux of time, order dated 16th August, 2002 may have attained finality. There is no plausible explanation of delay in approaching court, questioning order dated 16th August, 2002.
5. In the above conspectus, no relief can be granted to the petitioners.
6. Writ petition stands dismissed.
7. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
