Initially, M.C.No.4/2017 is filed by wife for divorce and divorce was granted by the Family Court on 23.03.2018. As the petitioner remained exparte, he filed an application to set aside the said order, but he was not pursuing the application with due diligence. Therefore, the Family Court after granting reasonable opportunity, dismissed the application on 05.07.2022 and passed the order as follows: "Petitioner is absent. None represents the case of petitioner. It is noticed that already two more time have been given but not petitioner to proceed with case. Hence, petition is dismissed for non-prosecution." 3. This writ petition is filed by petitioner/husband for quashing of the said order. But he failed to evince any interest - 3 - HC-KAR CNR: KAHC010726042025 NC: 2026:KHC:36131 WP No. 33752 of 2025 in the divorce application. Notice was served upon him, but he did not appear before the Court. As such, he was set exparte. It is not the case that no opportunity was given to him, but he has not availed the opportunity. Even afterwards he filed an application to prolong litigation and not evinced any interest. As such it was rightly dismissed by the Family Court. 4.
