Accused No.4 in S.C.No.441 of 2026 pending before the Court of XLV Additional City Civil & Sessions Judge, Bengaluru arising out of Crime No.69 of 2025 registered by Cyber Crime Police Station, Bengaluru for offences punishable under Sections 67, 66 (C) of Information Technology Act, 2000 and Sections 351(3), 352, 75(3), 351(2), 79 r/w 3(5) of BNS, 2023 is before this Court in this successive bail application filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.69 of 2025 was registered against 18 unknown social media account holders and others based on the first information dated 24.12.2025 received from Smt. Vijayalakshmi. In the said case, petitioner was arrested on 04.01.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court was rejected and therefore he had earlier approached this Court in - 3 - HC-KAR CNR: KAHC010382592026 NC: 2026:KHC:37488 CRL.P No. 8031 of 2026 Criminal Petition No.1857 of 2026 which was dismissed on 29.05.2026. Subsequently, accused nos.2 and 5 were granted regular bail in the present case by jurisdictional Sessions Court after the charge sheet was filed. It is under these circumstances, petitioner is before this Court in the successive bail application. 4. Perusal of the averments found in the first information as well as the charge sheet which is now filed against the accused persons would go to show that allegation against the accused persons is similar in nature. Accused nos.2 and 5 have been granted regular bail in the present case by the jurisdictional Sessions court. This court has granted regular bail to accused no.1 in Criminal Petition No.8037 of 2026 disposed of on 17.07.2026. 5. The alleged offences are triable by the Court of Magistrate and maximum punishment for the same is imprisonment for a period of seven years. Investigation of the case is now completed. Under the circumstances, I am of the - 4 - HC-KAR CNR: KAHC010382592026 NC: 2026:KHC:37488 CRL.P No. 8031 of 2026 view that petitioner's prayer for grant of regular bail is to be answered in the affirmative. 6. The petition is allowed. The petitioner is directed to be enlarged on bail in S.C. No.441/2026 pending before the Court of XLV Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime No.69/2025 registered by the Cyber Crime Police Station, Bengaluru City, for the offences punishable under Sections 67, 66 (C) of Information Technology Act, 2000 and under Sections 351(3), 352, 75(3), 351(2), 79 r/w 3(5) of BNS, 2023 subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 5 - HC-KAR CNR: KAHC010382592026 NC: 2026:KHC:37488 CRL.P No. 8031 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE NMS List No.: 1 Sl No.: 59
