JUSTICE RITESH KUMAR ORAL ORDER 4 17-08-2026 Heard the learned counsel for the petitioners and the learned APP appearing on behalf of the State. 2. The present anticipatory bail has been filed by the petitioners, apprehending their arrest in connection with Pakridayal P.S. Case No. 84 of 2011, for having committed offences under Sections 302, 201 and 34 of the I.P.C. It appears from the case diary that the Final Form was submitted in 2012, however the concerned Court, while differing from the report of the police, took cognizance against the petitioners and others in Patna High Court CR. MISC. No.35709 of 2026(4) dt.17-08-2026 2/2 2013 itself and since then the petitioner was an absconder and processes under Section 82 and 83 of the Cr.P.C. have already been initiated against the petitioners. 3. Considering the fact that processes under Sections 82 and 83 of the Cr.P.C. have already been initiated and in view of the judgment of the Hon’ble Supreme Court of India in the case of Lavesh v/s State (NCT of Delhi) reported in 2012 (08) SCC 730, State of M.P. v/s Pradeep Sharma reported in 2014 (2) SCC 17, Prem Shankar Prasad v/s State of Bihar reported in 2021 SCC OnLine SC 955, this Court is not inclined to entertain the anticipatory bail petition. 4.
