JUSTICE DR. ANSHUMAN ORAL ORDER 4 17-08-2026 Heard learned Sr. Counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner seeks regular bail in connection with Azamnagar P.S. Case No. 446/2025, lodged on 27/11/2025 under Sections 85, 103(1) and 3(5) of BNS, pending before the learned Chief Judicial Magistrate, Katihar. 3. As per the prosecution case, the FIR has been lodged against five named accused persons, including the present petitioner, who is the husband of the deceased. It is alleged that the marriage of the informant's daughter was solemnized with the petitioner six months prior to the incident. It is further alleged that there was continuous torture and Patna High Court CR. MISC. No.33360 of 2026(4) dt.17-08-2026 2/3 harassment directed at the deceased due to the non-fulfillment of dowry demands. Subsequently, the informant found his daughter hanging. 4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case merely because he is the husband of the deceased. It is submitted that there is no independent eyewitness to the alleged occurrence. Learned counsel further submits that the post- mortem report clearly shows the cause of death as asphyxia due to hanging, which suggests it is a case of suicide. The petitioner has a clean antecedent and is languishing in judicial custody since 25.12.2025. 5. Learned Counsel for the State, on the other hand, opposes the prayer for bail and submits that the deceased died an unnatural death within six months of her marriage. It is further submitted that although the post-mortem report mentions asphyxia due to hanging, it also clearly records the presence of multiple external injuries on the body of the deceased. This supports the prosecution's case that the deceased was brutally assaulted before her death. 6. In the present facts and circumstances, this Court is not inclined to grant regular bail to the petitioner. Patna High Court CR. MISC. No.33360 of 2026(4) dt.17-08-2026 3/3 7.
