The parties shall be bound by the Terms of Settlement entered into before the learned Mediator. It is clarified that in the event any party fails to adhere to the terms of settlement, such party shall be at liberty to invoke the jurisdiction of this Court under Section 11 of the Arbitration and Conciliation Act, 1996 to adjudicate the disputes between the parties arising out of the said development agreement.
