ORAL ORDER
The petitioner is before this Court calling in question proceedings in Crime No.285/2023, pending before the Addl. Chief Judicial Magistrate, Bengaluru Rural, for the offences under Sections 406 and 420 of Indian Penal Code.

learned counsel appearing for the petitioner, Smt.Waheeda M.M., learned HCGP appearing for respondent No.1, Sri.A.G.Ravi Kumar, learned counsel appearing for respondent No.2 and have perused the material on record. - 3 -

3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit reads as follows:
“1. I, Rohini Karthik filed a complaint before the respondent No. 1 police against the petitioner for the offences punishable under sections 406, 420 of the Indian Penal Code 1860 in Crime No. 285/2023 of Whitefield Police station pending on the file of Addl. C.M.M., Bengaluru. 2. At the intervention of elders, well-wishers of both parties the matter is settled amicably for the mutual benefit and advantage of both the parties the matter has been settled amicably on following terms, the petitioner has undertaken to pay respondent No. 2 Rs. 9,00,000/- in following manner: a. Rs. 50,000/- on this day. b. Rs. 1,00,000/- every month starting from August 2026 to December-2026 c. Rs. 3,50,000/- before 31/01/2027
3. We affirm that in view of the settlement entered into between the parties the Respondent No. 2 has no objection to quash the entire proceedings. 4. We jointly affirm that this compromise entered by us is voluntarily and willingly and that there is no fraud or misrepresentation or compulsion or coercion or undue influence or threat played between them. There is also no collusion between us herein in entering into this compromise petition. 5. We affirm that we have read and explained contents of this Compromise, each one understood the Contents, terms of this compromise and have affixed our respective signatures to the same on being satisfied to the same. - 4 -

6. The above settlement stated is full and final settlement and that neither of the parties are entitled to dispute or reopen the same in future.
WHEREFORE it is prayed that this Hon'ble Court may be pleased to record the terms of the compromise as above and accept the same as beneficial and advantageous to the parties and further be pleased to quash FIR in Crime No. 285/2023 in so far as petitioner is concerned for offences punishable under section 406 & 420 IPC by Whitefield PS pending on the file of Addl. C.M.M., Bangalore.”
4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of application for compounding being filed along with the joint affidavit as quoted supra and offences not being against the State, I deem it appropriate to accept the same and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following:
ORDER [I] Criminal Petition is disposed.

[II] Proceedings in Crime No.285/2023, pending before the Addl. Chief Judicial Magistrate, Bengaluru Rural, stands quashed qua the petitioner.
