1. This Civil Writ Petition is being filed under Articles 226/227 of the Constitution of India for issuance of an appropriate writ, order or direction, particularly a writ in the nature of Mandamus, directing the respondents to pay interest @ 12% per annum on all delayed retiral benefits from their respective due dates till the dates of actual payment, including interest for the month of February, 2017 on the delayed payment of the General Provident Fund (GPF) amount; further directing the respondents to release the balance retiral dues amounting to ₹49,131/- along with interest @ PARUL VERMA 2026.07.16 14:57 I attest to the accuracy and authenticity of this
order/judgment.
2 CWP-15628-2026 12% per annum, and to release the balance Medical Allowance of ₹4,000/- for the period from 01.02.2017 to 30.09.2021 along with interest @ 12% per annum from 01.10.2021 till the date of actual realization; and further directing the respondents to release the pending earned leave encashment for the period from 01.04.2016 to 31.01.2017 along with interest @ 12% per annum.
2. Mr. Chirag Kundu, Advocate filed fresh power of attorney on behalf of the petitioner, which is ordered to be taken on record. Registry is
directed to tag the same at appropriate place. Learned counsel for the petitioner, inter alia, contends that although the petitioner retired on 31.01.2017 and had submitted the complete pension case well before retirement, the respondents failed to release the retiral benefits within the prescribed time and kept raising frivolous and shifting objections, resulting in inordinate delay. It is submitted that the petitioner was compelled to file CWP No. 23838 of 2017 and thereafter COCP No. 123 of 2023, pursuant to which the respondents released the pension arrears and gratuity only during the pendency of the contempt proceedings. However, the balance pension arrears of ₹49,131/-, medical allowance of ₹4,000/- and earned leave encashment for the period from 01.04.2016 to 31.01.2017 are still unpaid.

Learned counsel further submits that the petitioner is entitled to interest on all delayed retiral benefits, including interest on the delayed payment of GPF for the month of February, 2017 under Rule 29(A)(2) of the PARUL VERMA 2026.07.16 14:57 I attest to the accuracy and authenticity of this
order/judgment.
3 CWP-15628-2026 Haryana Civil Services (General Provident Fund) Rules, 2016. Reliance is placed upon A.S. Randhawa v. State of Punjab (1997), J.S. Cheema v. State of Haryana (2014) and D.D. Tewari v. Uttar Haryana Bijli Vitran Nigam Ltd. (2014) to contend that delayed payment of retiral benefits entitles the petitioner to interest.

At this stage, learned counsel for the petitioner submits that he would be satisfied if the legal notice dated 15.03.2026, Annexure P-29, of the petitioner is decided by the respondents No.2 and 3/competent authority in light of judgment rendered by the Full Bench of this Court in A.S. Randhawa (supra) by passing a speaking order in a time bound manner.

Learned State counsel, appearing on advanced notice, submits that he has no objection in case a direction is issued to the respondents No.2 and 3/competent authority for time-bound consideration and decision of the legal notice dated 15.03.2026, Annexure P-29, of the petitioner by passing a speaking order.
4. Therefore, in view of the limited prayer made by learned counsel for the petitioner, the respondents No.2 and 3/competent authority is
directed to consider the legal notice dated 15.03.2026, Annexure P-29, of the petitioner in light of judgment rendered by the Full Bench of this Court in A.S. Randhawa (supra) and pass a speaking order, after affording him an opportunity to be heard, within a period of 02 months from the date of receiving a certified copy of this order. Further, the decision taken thereof PARUL VERMA 2026.07.16 14:57 I attest to the accuracy and authenticity of this
order/judgment.
4 CWP-15628-2026 shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by the respondent.
