JUSTICE ALOK KUMAR ORAL ORDER 2 19-08-2026 Heard the learned counsel for the petitioner and the learned A.P.P. for the State. 2. The petitioner seeks bail in connection with Saharsa Sadar PS Case No. 864 of 2022, instituted for the offence under Sections 302, 120B I.P.C. 3. The prosecution case, in brief, is that the dead body of the informant’s father was found lying inside the shop. It is alleged that the cause of the death is the dispute existing between the informant’s side and the accused persons. It is further alleged that someone has murdered his father with sharp cutting weapon. Lastly, it is alleged that it seems that the co- accused persons killed the informant’s father because of the land dispute. 4. The learned counsel for the petitioner submits that Patna High Court CR. MISC. No.59297 of 2026(2) dt.19-08-2026 2/3 the petitioner is not named in the F.I.R. and his name was later on added upon confessional statement of the co-accused. It is further submitted that the petitioner is in custody since 07.11.2022 and the petitioner has clean antecedents. 5. The learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 6. Having heard the parties and taking into consideration the fact that the petitioner is having clean history and his name has been subsequently added and also the fact that petitioner is in custody since 07.11.2022, this Court is inclined to grant bail to the petitioner. 7. Let the abovenamed petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-III, Saharsa, in connection with Saharsa Sadar PS Case No. 864 of 2022, subject to the following conditions :- (I) One of the bailors shall be the petitioner’s own or close family member. (II) The petitioner shall appear on each and every date fixed during the trial and also co-operate in the process of trial. (III) The petitioner shall not tamper with the Patna High Court CR. MISC. No.59297 of 2026(2) dt.19-08-2026 3/3 prosecution evidence or influence/ intimidate any witness during the course of trial. (IV) The petitioner shall not commit offence of a similar nature in future. In case of violation of any of the aforesaid conditions, the Trial court shall be at liberty to cancel the bail bonds of the petitioner. rinkee/- (Alok Kumar, J) U T
