JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Petitioner is before this Court seeking for the following reliefs: a) Call for records in the DPAR/403RRC/2024-RDPR- SUV-RDPR SEC-Part (1) which is produced and marked as Annexure-G from the respondent for kind consideration and perusal, in the interest of justice and equity. b) Issue a writ of mandamus to consider and to act in furtherance to Annexure 'D' dated 09.01.2025 and to direct the respondent to settle payment as per Technical Estimates estimated by KRIDL for 17 projects, being 11 in Tarikere Taluk and 6 in Kadur Taluk, in the interest of justice and equity. c) Issue a writ of mandamus to consider and to act in furtherance to Annexure 'D' dated 09.01.2025 and to initiate appropriate proceedings to conduct enquiry or any such actions against the erring/delaying the consideration of the issues pertaining to petitioner's payment as per Technical Estimates estimated by KRIDL for 17 projects, being 11 in Tarikere Taluk an 6 in Kadur Taluk. d) Direct the respondents to settle the petitioner grievances as per Technical Estimates estimated by KRIDL for 17 projects, being 11 in Tarikere Taluk and 6 in Kadur Taluk. e) Issue any Writ or Order or Direction as this Hon'ble Court deems fit in the circumstances of the case, in the interest of justice and equity. - 4 - HC-KAR CNR: KAHC010716352025 NC: 2026:KHC:37118 WP No. 33605 of 2025 2. The submission of learned counsel for the petitioner is that the petitioner having been awarded several works by respondent No.2, the payments in relation there to were not made and as such on a complaint being filed by the petitioner to respondent No.2, we are of the considered opinion that the State of Karnataka, represented by the Principal Secretary, Rural Development and Panchayat Raj Department, is a necessary party to the proceedings. Accordingly, the said authority is impleaded as Respondent No. 3. 3. The submission of the learned Additional Government Advocate is placed on record. It is submitted that, pursuant to the complaint lodged by the petitioner, Respondent No. 3, by communication dated 09.01.2021 (Annexure-D), directed that an enquiry be conducted into the matter. However, despite the said communication having been issued nearly one and a half years ago, no enquiry has been conducted. It is in these circumstances - 5 - HC-KAR CNR: KAHC010716352025 NC: 2026:KHC:37118 WP No. 33605 of 2025 that the petitioner has approached this Court seeking the aforesaid relief. 4. Learned Additional Government Advocate submits that the enquiry is in progress and seeks two months' time to complete the same. 5. In view of the said submission, Respondent No.3 and the designated Enquiry Officer are directed to complete the enquiry within a period of two months from the date of this order. 6.
